IN ANY EVENT, DEWEY'S PIZZA'S TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING UNDER THESE TERMS OR IN CONNECTION WITH YOUR USE OF OUR SERVICES SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU TO DEWEY'S PIZZA IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR ONE HUNDRED UNITED STATES DOLLARS (USD $100.00), WHICHEVER IS GREATER.
11. Indemnification
You agree to defend, indemnify, and hold harmless Dewey's Pizza, its officers, directors, shareholders, employees, independent contractors, agents, affiliates, successors, and assigns from and against any and all claims, actions, damages, liabilities, losses, costs, and expenses (including reasonable attorneys' fees and court costs) arising out of or in connection with:

EXCEPT FOR DISPUTES THAT QUALIFY FOR SMALL CLAIMS COURT AND EXCEPT FOR DISPUTES INVOLVING CLAIMS OF INTELLECTUAL PROPERTY INFRINGEMENT OR INJUNCTIVE RELIEF, YOU AND DEWEY'S PIZZA AGREE THAT ANY DISPUTE, CLAIM, OR CONTROVERSY ARISING OUT OF OR RELATING TO THESE TERMS OR THE BREACH, TERMINATION, ENFORCEMENT, INTERPRETATION, OR VALIDITY THEREOF, OR TO THE USE OF THE WEBSITE OR SERVICES, SHALL BE SETTLED EXCLUSIVELY BY BINDING ARBITRATION.
Arbitration shall be conducted under the rules of the American Arbitration Association (AAA) or JAMS, as mutually agreed upon, and judgment on the arbitration award may be entered in any court having jurisdiction thereof. The arbitration shall take place in the state where Dewey's Pizza is principally located, unless the parties agree otherwise in writing.
14.3 Class Action Waiver
YOU AND DEWEY'S PIZZA AGREE THAT EACH PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS ACTION, CLASS ARBITRATION, OR REPRESENTATIVE PROCEEDING. Except as otherwise provided by law, the arbitrator may not consolidate more than one person's claims and may not otherwise preside over any form of a class or representative proceeding.
14.4 Small Claims Court
Notwithstanding the foregoing, either party may elect to have disputes or claims heard in small claims court if the claim is within the applicable jurisdictional limits of the small claims court and the claim is brought on an individual, non-class basis.
15. Term and Termination
These Terms are effective from the date you first access or use our Website and shall remain in full force and effect until terminated.
